Commission publishes green paper on the modernisation of EU public procurement policy - towards a more efficient European Procurement Market.

The Commission has announced that it is due to make legislative proposals by early 2012, with a view to simplifying and updating European public procurement legislation so as to make the award of contracts more flexible and enable public contracts to be put to better use in support of other policies.
The green paper is intended to open debate on a variety of topics including:

  • The classification of public contracts;
  • The thresholds for the application of the EU procurement directive;
  • Excluded contracts;
  • The procedures provided for under the directive;
  • The distinction between selection and award criteria;
  • The needs of smaller contracting authorities;
  • Below threshold contracts;
  • Co-operation and joint procurements; and
  • Better access for SME’s and start-up’s;
While the green paper does not contain policy decisions, it does give an indication of some of the areas where the law might change in the future. The consultation period runs until 18 April 2011.
