Employment and Pensions Law
Philip Lee provides full-service employment, pension and equality advice to our public and private sector client base. We have a dedicated employment law unit consisting of two partners and three solicitors each of whom is an expert in these areas of law.
We take a proactive approach when advising our employer clients in relation to employment law. It is frequently the case that potential problems with employees can be avoided if precautionary steps are observed at all stages.
Employment Law
There will inevitably be occasions upon which a dispute with an employee simply cannot be avoided. It is an unfortunate fact of modern life that employment disputes can become acrimonious very quickly. Aggrieved employees become entrenched, and it is extremely difficult to achieve a resolution that is both quick and cost-effective. When acting for our employer clients, it is our practice to move quickly once an employment dispute arises in an attempt to resolve it with expediency. It is generally the case that the earlier that an employee’s complaint is addressed, the greater the likelihood that the employment difficulty can be resolved without recourse to the courts.
We regularly conduct seminars and training sessions for the middle- and high-level management and HR departments of our employer clients. We find these a very useful forum to assist our clients in understanding the manner in which they deal with employment issues including the disciplinary process.
Pensions Law
We have considerable experience and expertise in the area of pensions law, and we are well versed in the review and provision of advice on the application of EU Directives and Regulations in the area of pensions and employment law.
We believe that our in-depth and wide-ranging experience in the Pensions Law field equip us uniquely to meet the challenges faced by clients in this increasingly complex arena. Employee pensions arrangements are an area of law requiring both thorough knowledge and a delicate touch in amending or restricting the ambit of Schemes.
Our experience includes advising a public sector client that wishes to establish pension schemes for its employees under authorising legislation. A detailed review of the schemes’ structures and benefits was performed and a comprehensive trust deed and rules were drafted for both of the schemes.
We have also advised a separate public sector client in relation to the operation of the Public Sector Transfer Network (PSTN). This work typically involves a comprehensive review of the terms and conditions associated with the Scheme (in line with Section 4 of the Superannuation and Pensions Act, 1963) and advising on how to proceed, taking note of the best interests of their members and ensuring compliance with legislation
