Michael is a senior associate in the firm’s dispute resolution and litigation team. Michael advises clients across the public and private sectors on a wide range of commercial disputes, with particular focus on construction, procurement and health and safety matters.

He is experienced in the various forms of alternative dispute resolution, including conciliation, mediation, arbitration and adjudication under the Construction Contracts Act 2013, and his litigation experience ranges from the District Court to the High Court, Commercial Court and Supreme Court. He has vast experience of judicial review proceedings challenging high value procurement decisions issued by state authorities.

Michael also advises clients on non-contentious construction law matters and standard form contracts such as the Public Works Contracts, FIDIC, NEC4 and RIAI in addition to drafting bespoke construction contracts. He is experienced in commercial drafting and negotiation, as well as assisting with the provision of advices to regulatory bodies on procedural issues and in relation to their statutory functions and powers.

Michael is a regular contributor to articles and talks in the construction arena and lectures on health and safety law in University College Dublin and the Law Society of Ireland.

Recent Work

  • ADR – Advices, representation and advocacy in all forms of ADR including conciliations, mediations, adjudications and arbitrations for employers, contractors and designers.
  • Judicial review procurement proceedings – Acted for universities, the HSE, state authorities and private contractors in judicial review procurement challenge disputes, advising and managing the conduct of these proceedings. His experience includes advising on successful applications to lift the automatic suspension to the conclusion of such contracts and complaints around abnormally low tenders.  
  • Contract disputes – Advices and represented clients in disputes involving a number of standard and bespoke contracts, including NEC4, FIDIC, the Public Works Contract and RIAI. Michael was part of the Philip Lee construction team that acted for the Port of Cork in a high profile commercial court litigation over the construction contract for an €80 million project.
  • Construction claims – Acted for various clients in construction delay claims providing specialist advice on specific clauses in the Public Works Contracts pertaining to delay in construction projects. Michael regularly delivers training on construction claims and disputes to clients in addition to presenting at various Irish conferences.
  • Construction contracts – Experienced in the negotiation and drafting of project agreements, building contracts, professional team appointments and collateral warranties on numerous construction projects.
  • Negligence claims – Experienced in advising employers and consultants in respect of a variety of negligence claims and the management of High Court proceedings arising from same.
  • PPP work – Advised and represented clients in a number of PPP projects disputes in the housing and health sectors.
  • Health and Safety – Advised public and private clients on statutory obligations and assists them in managing risk in the health and safety arena. Experienced in advising clients on investigations by the Health and Safety Authority and prosecutions arising from workplace accidents.
