On 12 July 2025, Environment and Planning partner and head of our Climate and Environment group Alice Whittaker was interviewed by Ella McSweeney on the RTE Radio 1 CountryWide programme.
The interview followed reports that the EU Commission wrote to the Irish Government last month stating that Ireland “must demonstrate compliance” with the EU Habitats Directive when granting approximately 7,000 farm derogations in Ireland each year.
Alice discussed the ‘Dutch Nitrates’ case which found the application of fertilizers and grazing of cattle is a ‘project’ for the purposes of the Habitats Directive and the requirement to conduct an “Appropriate Assessment” on such projects in the context of granting derogations under the Nitrates Directive.
