Elaine Whelan



Elaine qualified as a solicitor in 2017 and has specialised in commercial property since joining the real estate team at Philip Lee in 2016. Prior to joining the real estate department, Elaine gained significant experience in a related sector working within the construction and procurement group at Philip Lee.


Elaine is experienced in advising clients across a vast range of transactions within the commercial property sphere including in the areas of receiverships, renewables, commercial leasing and landlord and tenant law, development set up and new homes, PRS acquisitions and forward sales.


Elaine advises solar and wind farm developers on options for leases, wayleaves and all legal property matters relating to these developments. Elaine regularly advises on the property element of high value and complex portfolio acquisitions in the renewables sector and has advised institutional and private lenders in funding wind farm developments.


In addition, Elaine has advised property developers on site acquisitions, title rectification, development set up, overall estate management and the ultimate disposal of the units. Related to this, Elaine has particular experience in the forward sale and purchase of hundreds of residential units for both developers and institutional investors, having on numerous occasions worked from the outset on these transactions through to acting in the completion of the ultimate acquisitions of units.


Elaine has a particular interest in examining complex and problematic titles with a view to providing and implementing simple and practical solutions with the client’s ambition for the property in mind.


Alongside property development, renewables and title rectification, Elaine has extensive experience in landlord and tenant law (transactional and advisory). She regularly acts for landlords and tenants on commercial leasing transactions and advises various clients on the management of their commercial leasing portfolios in Ireland.
